ROLL N RELAX — HIRE AGREEMENT, WAIVER & INDEMNITY

1. PARTIES
This Hire Agreement is made between:
Business: Roll n Relax (“the Provider”, “we”, “us”, “our”)
and the "Hirer / Participant" that completes this agreement
2. SERVICES & EQUIPMENT
Roll n Relax agrees to provide leisure hire equipment and/or setup services which may include but are not limited to:
Bikes / e-bikes / Helmuts
Picnic accessories
Beach cabanas
Chairs
Picnic furniture
Towels and soft furnishings
Leisure equipment
Food or beverage accessories (if applicable)
(“Equipment”)
The Hirer agrees to hire and use the Equipment subject to the terms below.
3. CONDITION & USE OF EQUIPMENT
The Hirer agrees:
Equipment must be used safely and only for its intended purpose
No misuse, modification, or unsafe use
No sub-hire or transfer to another party
Equipment must remain at agreed location unless approved
All children must be supervised at all times
Animals must be controlled and kept from damaging equipment
No open flames inside cabanas
No glass where prohibited by local rules
The Hirer accepts responsibility for all persons using the Equipment during the hire period.
4. WEATHER & ENVIRONMENTAL CONDITIONS
The Hirer acknowledges that beach and outdoor environments involve changing conditions including:
Wind
Heat exposure
Sand movement
Uneven surfaces / pathway hazards
Water proximity
The Hirer accepts responsibility for monitoring conditions and using Equipment safely.
Roll n Relax may cancel or modify hire due to unsafe weather.
5. RISK ACKNOWLEDGEMENT
The Hirer acknowledges that participation in outdoor leisure activities and use of hire equipment involves inherent risks including but not limited to:
Slips, trips and falls
Heat exposure
Dehydration
Sunburn
Equipment movement
Bicycle incidents
Interaction with other beach users
Animal interactions
The Hirer voluntarily accepts all risks associated with participation.
6. WAIVER & RELEASE
To the maximum extent permitted under Australian and Queensland law, the Hirer agrees:
To release Roll n Relax from liability for injury, loss or damage arising from participation or equipment use
That participation is voluntary
That the Hirer assumes all inherent risks
This release applies to:
Personal injury
Property damage
Financial loss
Consequential loss
Except where liability cannot legally be excluded.
7. INDEMNITY
The Hirer agrees to indemnify and hold harmless Roll n Relax against any claims, demands, damages, costs or expenses arising from:
Hirer misuse of equipment
Breach of this agreement
Negligent behavior by Hirer or guests
Damage caused by pets, children, or invitees
Failure to follow safety instructions
This indemnity survives completion of the hire.
8. DAMAGE & LOSS
The Hirer agrees to pay for:
Lost equipment
Damaged equipment
Excessive cleaning
Breakage
Theft during hire period
Costs will be charged at repair or replacement value.
9. BICYCLE / E-BIKE ADDITIONAL TERMS (IF APPLICABLE)
Where bikes or e-bikes are hired:
The Hirer confirms:
They are physically capable of riding
They understand road/shared path rules
Helmets must be worn
Local laws must be obeyed
No riding under influence of alcohol or drugs
Use is at the Hirer’s own risk.
10. HEALTH DECLARATION
The Hirer declares:
They have no known medical condition preventing safe participation
OR
They accept responsibility for managing their condition
11. CONSUMER LAW NOTICE (AUSTRALIA)
Nothing in this agreement excludes, restricts or modifies rights under the Australian Consumer Law that cannot be excluded.
Where services are recreational services, liability for certain risks may be limited under Queensland Civil Liability legislation.
12. MEDIA CONSENT (OPTIONAL — KEEP OR REMOVE)
The Hirer consents / does not consent (circle one) to photos or videos being used for marketing.
13. GOVERNING LAW
This agreement is governed by the laws of Queensland, Australia.
14. SIGNATURE
By signing below, I confirm I have read, understood and agree to this Hire Agreement, Risk Waiver and Indemnity.
